Terms & Conditions

These Terms of Use (“Terms”) constitute a legally binding agreement between you, whether as an individual user or on behalf of an institution or organization (“you”), and Food Science and Culinary Academy (FSCA) (“FSCA”, “we”, “us”, or “our”), regarding your access to and use of the website https://www.foodscienceacademy.com and any other linked services, platforms, tools, resources, applications, or media formats associated with FSCA (collectively, the “Site”). By accessing the Site, enrolling in any of our programs, or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms of Use and any policies referenced herein, including our Privacy Policy. If you do not agree with these Terms, you are advised not to use the Site.

1. Access and Use of the Site

You may access the Site via web browsers on desktop, mobile, or tablet devices. FSCA grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, educational, and non-commercial use only. This license does not include any resale or commercial use of our content, materials, or services unless expressly permitted through a written agreement.

You are responsible for maintaining the confidentiality of any login credentials or access codes provided to you and for all activities under your account. You must not allow others to impersonate you, access the platform under your credentials, or attempt to interfere with, manipulate, or misuse the Site or its features.

2. Educational Content, Intellectual Property, and Licensing

Unless otherwise stated, all content made available on the Site—including but not limited to course modules, lesson plans, videos, assessments, downloads, articles, webinars, images, graphics, software, functionality, and branding—is the exclusive property of FSCA and protected under applicable intellectual property laws.

You acknowledge that:

  • The content is licensed, not sold, and remains the sole intellectual property of FSCA

  • You may not record, reproduce, distribute, publicly display, modify, translate, publish, or create derivative works of any content without explicit permission

  • Course videos and resources are intended for individual educational use and may not be reused for commercial teaching, training, or publishing

  • Any FSCA trademarks, logos, or service marks may not be used without prior consent

  • FSCA reserves the right to track access and usage for internal academic integrity, content security, and compliance purposes.

3. User Conduct and Acceptable Use

By using the Site, you agree to:

  • Provide accurate and updated registration details when required

  • Use the Site and its services only for lawful, educational purposes

  • Not disrupt, interfere with, or damage the Site, its content, servers, or user experience

  • Not attempt to bypass any security or content restrictions, nor upload harmful code or files

 

Prohibited activities include but are not limited to:

  • Copying, scraping, or aggregating FSCA content for unauthorized redistribution

  • Framing, mirroring, or linking to the Site in a deceptive or unauthorized manner

  • Using bots, spiders, scripts, or automated systems to access, interact with, or overload the Site

  • Harassing, threatening, or misleading instructors, users, or staff via any FSCA platform

  • Accessing or using FSCA materials to build or promote a competing educational or consulting product

Any breach of these standards may lead to account suspension, removal from courses, and legal action if necessary.

4. Enrollment, Program Access, and Payment

Enrollment in FSCA courses and workshops is subject to availability and eligibility. By registering for a program, you agree to abide by the participation guidelines and complete any requirements stated within the course or shared by FSCA faculty.

Certain programs or services may require payment. When you make a purchase, you agree to:

  • Pay all applicable fees as outlined on the Site at the time of registration

  • Provide accurate billing and contact details

  • Acknowledge that access will be granted only after successful payment confirmation

Refunds are governed by FSCA’s cancellation and refund policies outlined in specific program pages or communications. We reserve the right to cancel or reschedule a course and will notify registered users accordingly.

5. Termination and Access Restrictions

These Terms will remain in full force while you use the Site. FSCA reserves the right to terminate or restrict access to any part of the Site or services, with or without notice, if:

  • You violate these Terms or any FSCA policy

  • You engage in fraud, abuse, or unauthorized sharing of our content

  • You disrupt learning environments or misuse our tools and services

In such cases, FSCA may suspend or delete your user account and block future access without refund. FSCA also reserves the right to pursue legal action in case of infringement, data theft, or breach of intellectual property rights.

6. Submissions, Feedback, and Testimonials

Any questions, comments, suggestions, testimonials, or other content voluntarily submitted to FSCA via email, forms, or the Site (“Submissions”) will be treated as non-confidential. You agree that FSCA shall have full rights to use, reproduce, publish, and adapt such content for educational, marketing, or operational purposes without restriction or compensation to you.

You warrant that your submissions are your own or that you have permission to share them. You waive any moral or attribution rights related to submitted content unless otherwise agreed upon in writing.

 

 

7. Modifications to Site or Terms

FSCA reserves the right to update or modify the Site content, programs, features, pricing, and these Terms at any time. While we strive to notify users of major changes, we are under no obligation to do so. Your continued use of the Site after any change constitutes acceptance of the updated Terms.

We may also temporarily suspend access to the Site due to maintenance, system upgrades, or unforeseen interruptions, and shall not be held liable for any disruption or data loss arising during such periods.

8. Limitation of Liability

To the fullest extent permitted by law, FSCA and its affiliates, directors, employees, or instructors shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to:

  • Loss of data, business opportunities, or goodwill

  • Errors or omissions in content

  • Delays, interruptions, or access issues arising from technical failures

  • Unauthorized access or misuse of your data

Our liability, under any cause of action, shall be limited to the amount paid (if any) by you for FSCA services during the six-month period preceding the claim.

​9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to any principles of conflicts of law. While the Food Science and Culinary Academy (FSCA) operates across multiple jurisdictions, including Singapore, India, and the United Arab Emirates, you agree that any disputes, claims, or legal proceedings arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts in Kuala Lumpur, Malaysia.
